Unfortunately, many people with diabetes face employment discrimination, and because our society makes decision based on assumptions or insufficient information regarding the disease. Definitely, the person who uses insulin needs basic accommodations that he/she can perform his or her work duty accordingly.
I'm professional registered nurse and certified diabetes educator, working in the Brooklyn VA Hospital. As a professional I must help patients understand the importance of good Diabetes Management to prevent development of dangerous complications. As a professional RN and CDE I become victim of discrimination and retaliation.
The laws protecting people with diabetes from discrimination require courts to fully understand how diabetes affects the individual involved.
American Diabetes Association has two goals:
1. No one with diabetes is denied a job
2. Each person with diabetes is afforded the reasonable accommodations necessary to protect health on the job
Employment civil rights laws:
The Federal laws protect federal employees with disability from discrimination.
The Rehabilitation Act of 1973 - Federal employee
The Congressional Accountability Act - Employees of Congress
The Americans with Disabilities Act Private employers
15 or more employees
Read below how to file official complain as a federal employee.
The information below based on my personal experience.
If you experience disability discrimination at work (federal job) follow this steps:
1.. Talk with your supervisor and explain the reason why you need the reasonable accommodation.
2. Pick up the application for reasonable accommodation from your HR (human resource). You must complete 1st page and the 2nd page completed by your medical provider.
3. Per policy, reasonable accommodation request MUST offer within 30 days.
In case you request for reasonable accommodation was denied. Don’t waste your time proceed to file the official complaint to ORM and in the meantime find a counselor (lawyer) who will represent you and help with legal aspects of your case.
Office of Resolution Management (ORM) - provides complaint processing services within the Department of Veterans Affairs (VA).
ORM will accept complains from an employee, former employee, or applicant for employment.
Remember you have ONLY 45 days to file official complain to ORM
If you are union member ask union representative to assist you, remember you have only 45 days to submit official complain.
Keep ALL communications between you and administration in writing (emails)
