My Case
If you stop on my website, I'm sure you are searching for help with discrimination at workplace. I have been working as a registered nurse in the Brooklyn VA Hospital (ICU) for 19 years. During this time, I received multiple awards in nursing.
My proficiency was outstanding for all these years.
In 2012, I was required to be off from work for over six months related to my health condition (diabetes Type I). Before I returned back to work in March 2012 my doctors and I requested reasonable accommodations based on my health condition.
The Chief of Nursing Department LV returned me back to ICU (against and in spite of medical advice from my doctors) and assigned me to the monitor telemetry station- where I had to sit and watch the monitors of critical patients’ vital signs to alert the responding personnel. Because of the extreme and known shortage of nursing staff in ICU no one could switch with me for my breaks or for me to check my blood sugar.
In August 2013, I passed out at telemetry station because I couldn’t find anyone to relieve me and at the same time my blood sugar was so low that I couldn’t even make any sense. All above mentioned working condition caused aggravated diabetes and developed new complications.
I’ve complained to Chief of Nursing, HR, EEO, Director and nursing union, hoping that Hospital will address my request. The Administration refused to provide reasonable accommodation.
The Administration and my nurse supervisor retaliated against me by lowering my proficiency from outstanding to satisfactory without any reason.
I’ve applied for nurse informatics position in 2013. I was well qualified for the position and it can suit my needs for reasonable accommodation but administration and my nurse supervisor retaliated. I didn’t get this position and never received any letter why I was rejected.
I’ve had court pre-hearing in 2016 at EEOC. My attorney and I asked the Judge to proceed with this case to court.
In 2015, I filed the 2nd complaint of discrimination and retaliation with ORM. After complicated surgery in 2015, I’ve requested FMLA time to attend physical therapy. HR and my nurse manager rejected my request and demanded more medical documents. I couldn’t attend physical therapy. After a few months, I’ve found that my FMLA time was signed long time ago and all doctor’s notes was unnecessary, just to give me hard time. Failure to attend post-surgical recovery caused aggravated my health condition. Even at the present time it causes pain and suffering.
Although I have been employed at the for many years, with outstanding proficiency reports, I have been treated differently since I requested a reasonable accommodation 6 years ago, and I am still subjected to and suffering from the retaliatory actions from HR and nurse manager for my voicing of complaints of discrimination against them. Going through three investigations I’m seeing that whole purpose of them to present that nothing is happening, “someone delayed the approval”, “I was not aware”, “I don’t remember” and etc.
